ALNMA, LLC., a Delaware limited liability company, Adult Lifestyles Association, Adult Lifestyles International Association, Lifestyles Association, ALNMAI (Adult Lifestyles National Member Association International), Adult Lifestyles Trade Industry Association, Lifestyles Industry Trade Association, Adult Lifestyles Trade Association, Lifestyles Trade Industry Association, Lifestyles Trade Association are Registered Trade Marks of ALNMA, including but not limited to ALNMA’s Network of Sites, also here in referred to as “ALNMA’s Network” "Association Network" or “ALNMA”, and all rights, conditions of use, terms of use, policies and guidelines shall remain whole and without separation. Trade Marks and Copyrights are under the sole ownership and control of ALNMA, LLC.

b. ALNMA, LLC is based in the State of Arizona, in the United States of America. ALNMA makes no claims that the Site(s) and the Content are appropriate or may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access the ALNMA Site(s) from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. ALNMA.com (the “Network of Sites”) is operated by ALNMA, LLC. The goal of the Site(s) is to provide an educational, stimulating, and supportive online community experience. This Agreement covers all aspects of our Site(s), unless otherwise noted. ALNMA may, in its sole discretion, modify or revise this Agreement at any time by updating this Web page and/or any page within ALNMA’s Network of Sites that makes references to “use”, with or without advance notice. You are bound by any such modification or revision and, therefore, should visit this page periodically to review any changes. If any modification or revision is unacceptable to you, you agree to stop using any of our sites. By your continued use of the Site(s), you are fully aware there may be future modifications, and it’s your sole responsibility to adhere to these modifications. Such modifications will reflect a revision date.

2. Usage Conditions - Your Use Is Your Responsibility.

a. You agree that when using the Site(s), you will act in a manner consistent with the goals of the Site(s), and by way of example, and not as a limitation, you specifically agree that:

i. You may not use the website(s) in any manner that could interfere with anyone’s use and enjoyment of the Web Site(s).

ii. You act in a manner that negatively affects other user’s ability to engage in the use of our Network of Sites.

iii. As a condition of your use of the Web Site(s), you will not use the Web Site(s) for any purpose that is unlawful or prohibited by these Terms and Conditions of Use.

iv. You may not assign, convey, subcontract or delegate your rights, duties or obligations here in.

v. You will not, intentionally or unintentionally violate any applicable local, state, national or international regulation or law.

vi. You will not post information on or download information from the ALNMA’s Network of Sites unless you have all rights and authority necessary to do so, as defined herein.

vii. You will not post any inappropriate, defamatory, foul, vulgar, obscene, sexually explicit, potentially libelous or slanderous, infringing, harmful, harassing, threatening, illegal or otherwise objectionable material or information to the ALNMA’s Network of Sites, including but not limited to, text, graphics, audio, and video files.

viii. You will not defame, abuse, harass, stalk, threaten, embarrass, cause distress, unwanted attention or discomfort, or otherwise violate the legal rights (such as rights of privacy and publicity) of any visitor to the Site(s) or representative of ALNMA. You may not express your disagreement with someone’s point-of-view by personal attacks, attacks based on another person’s race, national origin, ethnicity, religion, gender, sexual orientation, disability or other such condition or circumstance, and such attacks are strictly prohibited and will not be tolerated.

ix. You will not impersonate another person or entity, including but not limited to, an ALNMA representative, or communicate under a false name or a name that you are not entitled or authorized to use.

x. You agree not to aide a person who has been banned or deliberately hide a banned person’s existence from the administration.

xi. You will not post surveys, contests, chain letters, pyramid schemes, unnecessarily long messages, unnecessary or repetitive posts, multiple ratings for the same item, meaningless text, spamming, offensive declarations or exhortations, or other similarly disruptive content.

xii. You will not falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material posted on ALNMA’s Network of Sites.

xiii. You will not post any files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.

xiv. You will not attempt to “crack,” “hack,” “bomb,” manipulate or otherwise gain unauthorized access to other user accounts, ALNMA servers, ALNMA Services, ALNMA software, or any areas of the Site(s) not intended for Your access.

xv. You will not post, transmit, or distribute any unsolicited advertising, promotional materials or other forms of solicitation to users, individuals or entities, except in areas designated by ALNMA for such purposes.

xvi. You will not harvest, mine or otherwise collect or store personal information about others, including, without limitation, email addresses and the content of users.

xvii. This Site or any Site in ALNMA’s Network is to be used by you for your personal use only. Commercial uses of this Site(s) are strictly prohibited unless prior consent from ALNMA has been granted.

xviii. You agree that any personally identifiable information given out through the use of our Website(s) via our registered users areas, should always be done so with caution. Therefore, ALNMA specifically disclaims any liability with regard to any actions resulting from any participation in our Website(s).

b. Violation of any of the above may result in a warning, immediate termination of your account and/or banning/blocking from further access within Site(s) restricted public access areas (with or without notice). Please be aware, ALNMA’s Policies and Guidelines are in place for the welfare of all of our users (the “Public”) and our Business Members. Any offense we deem harmful to the Public and/or a Business Member may result in the reporting of your conduct to the appropriate authorities and/or legal action by the sole discretion of ALNMA, LLC or it’s appointed agent of service. ALNMA, LLC has no liability or responsibility to Users/Business Members or any other person or entity for performance or nonperformance of the aforementioned activities. If you believe your account or access to the Site(s) has been terminated in error, please contact us through ALNMA’s Support Network, AdultLifestylesSupportNetwork.com.

3. Public Areas.

a. If You use a public area of the Site(s) where Registered Member Users are allowed to post communications or other content (“Public Area”), including, without limitation, forums, blogs, ratings, surveys, polls, feedback or any form of communication made available to our Users, you agree that you are solely responsible for your own communications, the consequences of posting those communications, and your reliance on any communications found in the Public Area. ALNMA is not responsible for the consequences of any communications in the Public Areas. ALNMA attempts to create a safe and supportive environment for all individuals by taking measures to prevent offensive behavior. However, ALNMA does monitor the Public Areas to the best of our abilities, but makes no guarantee with respect to your experience in such areas. Anyone who feels that a posting of any nature is objectionable, is encouraged to notify ALNMA immediately. In cases where you feel threatened or believe someone else is in danger, You should contact your local law enforcement agency immediately.

b. ALNMA reserves the right (but is not obligated) to, without limitation: (a) record the communications in Public Areas; (b) investigate any allegation that a communication does not conform to the terms of this Agreement and determine in its sole discretion to remove or request the removal of the communication; (c) remove communications which are abusive, illegal, or disruptive, or that otherwise fail to conform with Usage Conditions above or otherwise with this Agreement; (d) monitor, edit, or disclose any communication in the Public Areas; and/or (e) edit or delete any communication posted on the Site, regardless of whether such communications violates these standards, each in ALNMA’s sole discretion.

4. User Registered Areas & Your Member Name and Password.

During the registration process, you will designate a member name and password for your account. You are responsible for all activities that occur under your member name and password, whether or not authorized by you, and for taking all reasonable steps to ensure that no unauthorized person shall have access to your password or account for the Site(s). By registering on ALNMA’s Site(s) you hereby agree that you will not (i) establish more than one member name (even if the member names are created using different email addresses or for different purposes), (ii) provide incomplete or inaccurate registration information, (iii) fail to update your registration information if it changes, or (iv) select a member name or photo of yourself that is intended to mislead others about your identity or that infringes or otherwise violates a third party’s intellectual property, publicity, privacy or other rights.

5. Site(s) Content.

a. You acknowledge that ALNMA makes every attempt to pre-screen Content and shall have the right in its sole discretion to remove material posted on the ALNMA’s Network.

b. ALNMA gives no warranties to ALNMA’s Site(s) Content. We maintain a high level of management, moderation, adherence to policies, procedures, conditions, terms and overall guidelines to help ensure the best quality of services are observed at all times. However, to warrant such services would create limitations beyond anyone’s practical use of our services.

c. ALNMA reserves the right at all times to monitor communications on ALNMA’s Network of Sites.

d. All the Content of the Site(s) is protected by copyright and other United States and foreign intellectual property and related laws. The Content includes both material owned or controlled by ALNMA and material owned or controlled by third parties and lawfully permitted use by ALNMA.

e. ALNMA authorizes you to view and download a copy of the Content on the Site(s) solely for your personal, non-commercial use provided that you do not modify or remove any copyright or other proprietary rights notices that are contained in the Content. You MAY NOT sell or modify the Content or reproduce, display, publicly perform, distribute, or otherwise use the Content in any way for any public or commercial purpose without the written permission of ALNMA. Any special rules for the use of certain software and other Content accessible on the ALNMA Site(s), may be included elsewhere within the Site(s) and are incorporated into this Agreement by reference.

f. Any use of the Content not expressly permitted by this Agreement is a breach of this Agreement and may violate copyright, trademark, and other laws. All rights not expressly granted herein are reserved by ALNMA.

CAUTION: You may find content to be offensive, harmful, inaccurate and/or deceptive. If so, please report such findings immediately to our Support Network.

6. User Content.

a. ALNMA allows you to post a variety of information, text, images and other content to ALNMA’s Network (“User Content”), such as ratings and reviews about products and services and information about yourself for your profile page. You agree to exercise caution in posting any User Content that contains information about yourself. You acknowledge that User Content may be viewed by other Users for purposes you may not have intended. Please refer to our Privacy Policies.

b. ALNMA also invites you to submit User Content consisting of writing and other forms of creative expression (collectively, “User Content”) to ALNMA for potential posting in various site sections. ALNMA reserves the right to determine whether to post any User Content submitted by Users in any area, and to remove any such User Content from any that area, at any time in its sole discretion. You shall at all times retain all right, title and interest in and to any Content that you submit subject to the nonexclusive rights and licenses granted to ALNMA.

c. By submitting Content and other User Content to ALNMA, you represent and warrant that you have all rights and authority necessary to post such content. If you choose to submit Content for potential posting in a site area, you must provide ALNMA with accurate information regarding your submission of Content. Please notify ALNMA if you do not wish such information to be displayed on the Site(s). You agree to exercise caution in deciding what information to provide in connection with your Content, including whether to provide Your real name, professional alias, or username for display in connection with your Content.

d. By submitting User Content to the Public Areas, you represent and warrant that such submission is non-confidential. If you wish to keep any business information, ideas, concepts, or other information private or proprietary, do not post Content to the Public Areas or otherwise to the Site(s). Please do not post any link to any third-party Web Site(s) unless you have permission from ALNMA, we will strictly enforce this policy.

7. Copyright Notification.

ALNMA DOES NOT permit copyright infringing activities and other infringement of intellectual property rights on its Site(s), and ALNMA will remove all Content and User postings if properly notified that such Content or User postings infringe on another’s intellectual property rights. If you are a copyright owner or an agent thereof and believe that any User posting or other Content in any Public Area of the Site infringes upon or otherwise conflicts with your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing our Copyright Agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for further detail):

a. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

b. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

c. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;

d. Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail address;

e. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

For clarity, only DMCA notices should go to the Copyright Agent; any other feedback, comments, requests for technical support, and other communications should be directed to ALNMA, Adult Lifestyles Support Network, Copyright Agent Contact area of the Site. You hereby acknowledge and agree that if you fail to comply with all of the requirements listed above, Your DMCA notice may not be valid.

8. Trademarks.

ALNMA and ALNMA’s logo(s) and other ALNMA’s product and service names are trademarks, with no exception to ALNMA’s Network of Sites and Domain Names of ALNMA, LLC. You agree not to display, reproduce or otherwise use in any manner the ALNMA’s trademarks without ALNMA’s prior written permission,.

9. Linking Policy.

ALNMA permits you to link to the Site(s) for personal, noncommercial purposes only upon providing written notice to us. However, if you are business owner, you must have an Approved ALNMA Business Membership prior to using our Seal of Approval and/or any links to any of ALNMA’s Network of Sites. For personal use you may link to the Site(s) by using the words “ALNMA and or Adult Lifestyles Association” with an active link to the Site(s) or by displaying the full Web address for the Site(s) or Web page therein (e.g., “www.ALNMA.com”). You may not create a link from a Web Site that has obscene, profane, violent or otherwise objectionable material. ALNMA reserves the right to request that any link to any of our Sites be removed immediately, with or without cause, in its sole discretion.

10. Third-Party Links and Other Resources.

ALNMA may provide links to third-party Web Sites or references to other resources on ALNMA’s Network of Sites. ALNMA has no control over or responsibility for such Web Sites and other resources. You hereby agree that ALNMA is not responsible for the availability of such external Web Sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from, or the privacy policies or other policies of such Web Sites or other resources. ALNMA provides these links and references to you through our Adult Lifestyles National Member Association, these businesses are Approved Business Members, and by granting such membership it entitles said businesses the opportunity to link to us, in addition to offering other advertising media. However, ALNMA provides Third Party link resources in many other ways, such as, awareness, education, news, events, forums, blogs and other organizations we are affiliated with. All ALNMA Business Member links and/or marketing are subject to ALNMA approval prior to display on any of ALNMA’s Network of Sites. ALNMA maintains a very strict policy towards all content displayed in ALNMA’s Network of Sites, but we do not warrant such content, here in referenced as “Third Party Links”.

11. Rated Resources.

The ratings and reviews of resources, products and services found in our Ratings and Reviews, reflect only the personal opinions of the individual Users who submit ratings with reference to our ALNMA Business Members. ALNMA does not endorse any product or service on this listing except where specifically noted. You agree that ALNMA is not liable for any damages incurred as a result of the rating system.

12. Polls and Surveys.

As a primary benefit of being an Adult Lifestyles Association Registered Member, you may participate in our Polls and Surveys. Many of the Polls and Surveys represent the voice of Your Adult Lifestyles Community. Your voice is heard locally, state, nationally and global. Such Polls and Surveys express issues and concerns with our Adult Lifestyles Community, for example, rights of individuals to pursue their individual “lifestyle” interests and preferences, legally and lawful activities, unlawful pursuit of individuals, groups, clubs and businesses due to individual moral beliefs banning such lawful activities. Harassment of individuals or business owners through wrongful public postings. Such infringement of rights of individuals and businesses is key focus of the Adult Lifestyles Association. ALNMA represents unity, united as one without difference to individual adult lifestyle interests, but in common to support our community. United in a sole effort to support awareness, education and enjoyment of the adult lifestyles. Your participation is greatly encouraged, your personal information is NEVER given out, not even your email address.

13. ALNMA’s Paid Services.

If You choose to subscribe to one of ALNMA’s paid services, such as Adult Lifestyles National Member Association, the Adult Lifestyles Trade Industry Association or any form of services provided by ALNMA, including Donations, the following will apply depending on which service you select.

a. You are responsible for providing valid information upon purchase of services. You represent and warrant that you are an authorized user of such information, and you agree to pay all charges resulting from such Services, including, without limitation, any unauthorized charges incurred prior to you notifying ALNMA of such charges. ALNMA reserves the right to change prices or institute new charges for any Services offered, by notice to you at the email address you have provided to us. If you wish to view or update your billing information, please go to the “My Account” section of the appropriate account section. Should You have any questions, do not hesitate to contact us through ALNMA’s Support Network, we are here to help in any way.

b. ALNMA’s Business Membership terms are annual, with exception to ALNMA’s Marketing Services, unless specified otherwise on the Site(s). Membership is not automatically renewed following the initial term on an annual basis. We provide a 60 day, 30 day, 15 days and a 5 day notice prior to membership expiration. Should you fail to renew your Business Membership and/or any paid services, you agree to cease and desist from any use of ALNMA’s Seals, logos or materials with reference to the paid services you selected. You are responsible for all service fees until notice of cancellation is received from you by ALNMA.

c. ALNMA may modify or change the benefits offered to any paid services at any time in its discretion, such changes will reflect an advanced date and notifications will be sent to your email address provided where applicable, in addition to updates within ALNMA’s Network of Sites.

d. Cancellation. If You wish to upgrade or cancel your Paid Services at any time, please use our contact forms provided in your selection of service. At any time, you may contact us through our Support Network.

Note: Adult Lifestyles National Member Association (ALNMA), Policies and Guidelines for Business Memberships may be found on our main ALNMA.com Site. Membership requests require pre-approval, NO exceptions. ALNMA DOES NOT sell memberships! The ALNMA Logo and Seal of Approval stands for quality, integrity, professionalism and excellence in service and outstanding representation of the Lifestyles (public) Community and the Lifestyles Business Industry.

14. Leased Storefronts - Discontinued Until Further Notice - 12-01-2008

ALNMA Business Members have many opportunities to market their services or products within ALNMA’s Network of Sites. One way is by leasing a Storefront in the Adult Lifestyles Community Mall, thus becoming a Merchant/Vendor. ALNMA does not profit from the sale of services or products offered in the Mall. By use of any merchant Mall service, you hereby agree that ALNMA shall not be liable for any interactions between you and the Storefront owner. If you have any questions or concerns regarding any transaction or other interaction at a Storefront, please contact the Storefront owner. Please also contact ALNMA to report any bad experience you may have had with a Storefront owner. While we are not responsible for the conduct of Storefront owners, we will endeavor to maintain the quality of products, services and customer service offered at the Adult Lifestyles Community Mall. ALNMA does NOT allow processing or purchase of products in the Community Mall, all products and services are for display purposes only, all purchases will be conducted on Storefront owner’s Web site or so designated by Storefront owner. 15. Disclaimer Of Warranties.

a. ALNMA’s Network of Sites and the Content are provided on an “as is” basis. ALNMA, to the fullest extent permitted by law, disclaims all warranties, either express or implied, statutory or otherwise, including, without limitation, the implied warranties of merchantability, non-infringement of third parties’ rights, and fitness for particular purpose. Without limiting the foregoing, ALNMA makes no representations or warranties with respect to (i) the accuracy, reliability, completeness, availability or timeliness of the Content, software, links, or other materials or services provided on or through the use of our Site(s).

b. Without limiting the foregoing, ALNMA does not endorse products and/or services. Based upon ratings, reviews and testimonies of said services, ALNMA may, by sole discretion, offer editorial comments related to such reporting. But it is your responsibility to evaluate the accuracy, completeness or usefulness of any information, service or product opinion, advice, statement or other Content posted on the Site(s). Reliance on any information provided by ALNMA, ALNMA employees, persons providing information on the Site(s) at the discretion of ALNMA, or other Users, is solely at your own risk.

16. Limitation of Liability.

a. In no event shall ALNMA, its service providers, or any third parties mentioned on the Site(s) be liable for any direct, indirect, special, punitive, incidental, consequential, or exemplary damages (including, without limitation, negligence, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption), even if ALNMA has been advised of the possibility of such damages, resulting from (i) the use of or inability to use the Site(s), (ii) the cost of procurement of substitute goods and services, (iii) unauthorized access to or alteration of your account by anyone other than ALNMA, (iv) statements or conduct of any third party on the Site(s), (v) the use of any benefits obtained in connection with any promotions or like events on the Site(S), or (vi) any other matter arising out of or in connection with the Site(s), its services or this Agreement.

b. In the event that you are in a jurisdiction that does not allow the exclusion of implied warranties or that does not allow the limitation or exclusion of liability, the total liability of ALNMA, if any, shall be limited to the amount paid by you to access or use the Site(s). ALNMA shall not be liable under any theory of indemnity.

c. Any and all disputes arising out of or related to these Terms of Use and/or Your relationship with ALNMA, LLC, and/or Your use of ALNMA’s Network of Sites shall be submitted to binding arbitration according to the rules of the American Arbitration Association. The parties to the arbitration shall evenly divide any and all costs of the arbitration. Neither party shall be entitled to attorney fees.

17. Indemnity.

You agree to indemnify and hold ALNMA, and our subsidiaries, affiliates, employees, officers, directors, agents, licensees or other partners, harmless from and against any claim, demand, losses or other liability, including, without limitation, reasonable attorneys’ fees and expenses, arising out of Content you submit, post to or transmit through or for posting on the Site(s), your use of the Site(s), your connection to the Site(s), your violation of this Agreement, the receipt of any benefits obtained by you in connection with use of said Site(s), or your violation of any rights of another.

18. Governing Law.

This Agreement and the relationship between you and ALNMA shall be governed by the laws of the State of Arizona without regard to its conflict of law provisions. You and ALNMA agree to submit to the personal and exclusive jurisdiction of the courts located within the County of Maricopa, State of Arizona, including, without limitation, any claim involving ALNMA or its affiliates, employees, contractors, officers, directors, telecommunication providers, and content providers. The failure of ALNMA to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision. If any provision of the Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Agreement remain in full force and effect. You may not assign the Agreement or any of your rights or obligations under the Agreement without ALNMA’s express written consent. The Agreement inures to the benefit of ALNMA’s successors, assigns and licensees. The section titles in the Agreement are for convenience only and have no legal or contractual effect.

19. Privacy Policy.

We take your privacy seriously! Please read the following to learn more about our privacy policy Information Collection and Use General Use Of Information.

a. When you register with ALNMA’s Network, we ask for business or personal information. None of this information is shared unless it is so noted as public information. Primarily, business profiles reflect the nature of business, links to the business site and only information the business so elects to be shown as public information. Individual registration does not reflect private information of any kind. No email or name information is shown.
